The Constitution of CSSA was born in Term 2007~2008. What you see below is the Chinese version of the Constitution (draft 2007~2008). It also has an English version.

○佛罗里达国际大学(以下简称FIU)中国学生学者联谊会是由在FIU的中国学生,学者及教职员工组成的非赢利性互助服务组织。
○FIU中国学生学者联谊会旨在为会员服务,加强会员间联系增进会员与周边社区以及FIU校友等的交流。
○FIU中国学生学者联谊会实行以民主为最高准则的管理体制。  



○会员资格:在FIU ( 包括FIU各学院,系,医学中心及其它附属机构) 的中国学生,学者,研究人员,教师及其它在FIU的工作人员,可以成为本会会员,享受本会权利,承担本会义务。
○会员权利和义务:会员享有平等选举权及被选举权。会员有权监督质询执委会和监委会的工作。会员有权参加联谊会各项活动。会员应以各种方式直接或间接地为联谊会作出贡献。  


组织和机构


(一)联谊会会员大会  


○联谊会会员大会是联谊会最高权力机构。联谊会主席有权召集会员大会,并应于大会召开前十五日前向会员发出通知。监委会亦有权依据第八条招集会员大会。 大会可以以电子形式召开。如以现场大会方式,大会应在FIU校园内或校园附近以合理方便的时间及地点召开。
联谊会成员有权对主席和执委会成员进行监督,并可依照第九条召开会员大会。  
联谊会会员大会享有对联谊会章程的解释权。

(二)主席及执行委员会


○FIU中国学生学者联谊会执行委员会(执委会)实行主席负责制,主席依第九条选举产生。主席任期一年 ( 当年12月1日至次年11月30日) ,可连选连任。
主席应接受监督委员会 ( 监委会) 的监督。
执委会是联谊会日常行政机构,应不少于五人 ( 含主席) 。
执委会成员应由主席任命,对主席负责,并在监委会备案。主席有权撤换执委会成员。
主席撤换执委会成员,应在二十四小时内通知监委会及会员并于四十八小时内向监委会 提出一详细书面报告,解释原因。
当执委会成员少于五人时,主席应于七日内任命增补人选。
主席及执委会负责联谊会日常工作,组织文化,体育,学术等活动,实现联谊会之宗旨。
主席应负责安排每年新生的接待工作。
主席在校外代表联谊会与其它个人和组织交往,应随时向监委会 报告重大事宜的决定。
除非经会员大会批准,主席 ( 及其他任何人) 不得代表联谊会参与政治活动。
主席本人不得兼任 财务主管 。
主席应于每年五月及换届后三十天内各公布一次工作报告及财务报告。
当主席因故不能行使职权时,应指定代理主席代行其职权。

 

(三)监督委员会


○监督委员会 ( 监委会) 是联谊会的常设监督机构及立法机关,负责监督主席及执委会的工作和联谊会章程的起草、修改及监督工作。
监委会成员不得兼任执委会成员。
监委会应由三人组成,实行多数决定制。监委会成员应由选举产生。选举应与主席选举同时举行,任期一年 (12月1日至次年11月30日) ,可连选连任。
监委会有权随时了解主席及执委会的工作情况,要求主席向其汇报工作。主席应于接到通知后七日内向其汇报工作。
监委会有权召集会员大会 ,并应在大会召开前十五日内发出开会通知及提案。
监委会不得干预主席及执委会日常工作。
当会员大会罢免主席后,监委会应代行主席及执委会工作。
○百分之十五以上会员(不得少于三十人)可联合要求召集会员大会。监委会应于联合提议后三十天内召开大会并于大会召开前十五日内发出开会及议案通知。  

 


○联谊会选举以民主、公平为原则,执行过程公开透明
○选举应于每年11月1日至15日间进行。监委会负责选举的组织工作。如监委会成员参与下届选举,应自行回避。监委会应至少于选举前十五天公布选举时间安排,选举前七天公布候选人名单,候选人竞选声明以及候选人简介。
监委会应采取合理可行的方式将选举安排通知尽可能多的成员。
监委会应采取合理方式投票选举 ( 包括电子投票) 。
候选人应在选举前两周向执委会提出书面竞选声明。
○联谊会主席经选举产生,选举后得票最多者当选。如有一人以上得相同最多票,应于七日内对得相同最多票者进行第二轮投票。
○监委会成员选举应与主席选举同期举行,得票最多的三名候选人当选。如因候选人得票数相同导致无法确定监委会成员,应于七日内对得票数相同者进行第二轮投票。  

 


○联谊会投票实行保密原则。未经投票人允许,投票主持人不得对外泄露投票内容。
○以下事宜应由会员大会投票,并由三分之二以上投票成员(但不得少于百分之十五的全体会员)同意通过。
1) 修改章程
2) 罢免主席及罢免监委会成员。
如无特别规定,其它事宜只需投票会员半数(但不得少于百分之十五的全体会员)通过即可。
○会员可以委托他人投票,代理投票人应于投票前将书面委托书交给监委会。会员可在选票上注明弃权。弃权票应计如投票总数。
○本章程经由投票会员三分之二以上(但不得少于百分之十五的全体会员)同意通过生效。  

 

罢 免

○因下列原因可罢免联谊会主席:
1 、主席日常工作严重失职;
2 、主席因为其他原因致使其留任将对联谊会产生严重不良影响的。其他原因包括严重犯罪、财政严重不明、严重干预选举的民主、公平地进行等情形。
○因下列原因可罢免监委会成员:
1 、当发生主席罢免条件时,监委会没有履行监督职责的;
2 、主持选举时严重徇私舞弊的;
3 、其它严重失职行为。  

 

财务制度

○联谊会财务制度坚持公开透明原则。
联谊会特设财务主管一名,由主席提名,经监委会批准。财务主管应向主席负责,并随时接受监委会查询。
财务主管应保证健康的财务帐目。
联谊会成员有权要求澄清联谊会的所有财务帐目。

PREAMBLE

Florida International University Chinese Student and Scholar Association (FIUCSSA), a non-profit organization consisting of Chinese students, scholars, staff and faculty at Florida International University, is established with the mission of mutual help and service.
The purpose of this organization is to serve and consolidate its members, and promote the exchange among its members, FIU community and FIU alumni.
FIU CSSA adopts Democracy as the ultimate principle for its operation.

 

 

ARTICLE I. MEMBERSHIP

 

Section 1. Criteria for Membership

CSSA is open to any duly registered student, scholar, researcher, professor and staff in good academic standing at Florida International University (including all the departments and schools, medical center and its affiliates). All members enjoy the rights and undertake the obligations of this organization.

Section 2. Rights and Obligations

All members enjoy equal rights of voting and being voted. They are entitled to oversee and question the work of Executive Committee and Oversight Committee. They are entitled to participate in all the activities initiated by this organization and shall make their due contributions to this organization.

 

 

ARTICLE II. ORGANIZATIONAL STRUCTURE

 

Section 1. CSSA Member meeting

a) CSSA Member meeting is the ultimate power structure. The president of CSSA shall serve as the presiding officer over the conference, and notify members the venue and time at least 15 days prior to the scheduled conference. The Oversight Committee is also entitled to organize member meeting. The conference can be an e-conference, or held in convenient time and venue.
b) All members are entitled to oversee the President and assemble the conference, as specified in Section 2 of Article III.
c) CSSA Member meeting is entitled to interpret the Constitution.

 

Section 2. President and Executive Committee

a) The president, who has the full responsibility for its work, administers CSSA Executive Committee. The president shall be elected according to Section 2 of Article III. The term of the president is one year, extending from Dec. 1 the current year to Nov. 30 of the next year. The president can be reelected.
b) The Oversight Committee shall oversee the president.
c) The Executive Committee is the standing administration of CSSA, consisting of no less than five members (including the president). Members of the Executive Committee shall be appointed by and report to the president. They shall be filed by the Oversight Committee. The president is entitled to replace the members.
d) The president shall notify the replacement of Executive Committee members to the Oversight Committee and its members within 24 hours and submit a detailed written report within 48 hours to explain the reasons.
e) The president shall appoint new members if the Executive Committee has less than five members.
f) Proceeding from the principle of this organization, the president and the Executive Committee shall be responsible for the routine work of CSSA and organizing entertainment, sports and academic activities.
g) The president shall take responsibility to organize people to welcome incoming Chinese students.
h) The president contacts individuals and organizations on behalf of CSSA outside of Florida International University and reports to the Oversight Committee about major issues.
i) The president shall not participate in any political activities in the name of CSSA without the acceptance of Member meeting.
j) The president shall not take the position of Treasurer concurrently.
k) The president shall publicize work report and financial report every May and within 30 days after his or her term.
l) The president shall appoint an acting president in his or her absence or incapacity.

 

Section 3. Oversight Committee

a) Over August 23, 2004 and legislature, is responsible for overseeing the president and the Executive Committee, and for drafting, amending the Constitution of CSSA and overseeing its implementation.
b) The Oversight Committee members shall not be the members of Executive Committee concurrently.
c) The Oversight Committee shall consist of three members and exercise the rule of majority vote. The members shall be elected along with the presidential election. The term is one year, extending from Dec.1 the current year to Nov.30 the next year. The members can be reelected.
d) The Oversight Committee shall be kept informed of the work of the president and the Executive Committee and request a report from the president. The president shall report to the Committee in 7 days upon notice.
e) The Oversight Committee is entitled to assemble Member meeting. It shall notify the CSSA members 15 days before the conference and submit a motion.
f) The Oversight Committee shall not interfere with the routine work of the president.
g) The Oversight Committee shall act in the place of the president and the Executive Committee if the Member meeting impeaches the president.?
h) 15% or over 15% of members (no less than 30 members) can request convening a Member meeting. The Oversight Committee shall assemble Member meeting in 30 days after the request. It shall notify the CSSA members and issue the agenda 15 days prior to the scheduled conference.

 

 

ARTICLE III. ELECTION

 

Section 1. CSSA election follows the principle of democracy and openness. The operation process shall be transparent.

 

Section 2. Election Procedures

a) The election shall be held between Nov.1 and Nov.15 each year. The Oversight Committee shall organize the election. The presidential candidates shall not participate in the election organization. The Oversight Committee shall notify the schedule at least 15 days prior to the election, and issue the candidate list, statements and profiles 7 days prior to the election.
b) The Oversight Committee shall notify as many CSSA members as possible the election schedule in a reasonable and feasible manner.
c) The Oversight Committee shall adopt a feasible way for voting (including e-voting).
d) The candidates shall submit to the Oversight Committee their written statements two weeks prior to the election.

 

Section 3. The president shall be duly elected if he or she gets the greatest number of votes. If there are over two candidates with the same votes, the second round of election shall be held in 7 days.

 

Section 4. The election for the members of the Oversight Committee shall be held simultaneously with the presidential election. The three candidates with the greatest number of votes shall be elected. If the members of the Oversight Committee cannot be elected due to the same votes for more than one candidate, the second round of election shall be held within 7 days.

 

ARTICLE IV. VOTING

 

Section 1. The election shall adopt secret ballots. The host of the election shall not publicize the content of ballot without the permission of voter.

 

Section 2. The Member meeting shall vote and two-thirds of the votes is required for:

a) Amendment to the Constitution.
b) Impeachment of the president or members of the Oversight Committee.
If there is no specific requirement, other activities shall be approved by a simple majority vote under the condition that no less than 15 percent of CSSA members shall vote.

 

Section 3. CSSA members can trust others to vote for him or her. He or she shall submit a written trust statement to the Oversight Committee. Members can vote abstention. The abstentions shall be counted as valid votes.

 

Section 4. The Constitution shall be ratified by the approval of two-thirds of the votes (Under the premise that no less than 15 percent of CSSA members shall vote.)

 

 

ARTICLE V. IMPEACHMENT

 

Section 1. The CSSA president can be impeached for the following reasons:

a) The breach of his public duties.
b) Any convicted crimes, misrepresentation of financial situations, severe interference with democratic process in election, and other activities which would make his position a serious negative impact on CSSA.

 

Section 2. The members of the Oversight Committee can be impeached for the following reasons:

a) Failure to take the responsibility of oversight to impeach the president whose activities lead to impeachment according to the Constitution.
b) Serious bleach and abuse of power in the process of election.
c) Other serious corruptive activities.

 

 

ARTICLE VI. FINANCIAL SYSTEM

 

Section 1. This organization shall adopt the principle of openness and transparency for its financial system.

 

Section 2. It shall have a treasurer, who shall be nominated by the president and approved by the Oversight Committee. The treasurer shall report directly to the president and shall prepare expenditure reports and budgetary reviews upon the request of the Oversight Committee. The treasurer shall guarantee sound financial statements. Members of this organization are entitled to ask for the disclosure of financial statements.
